Police vodka chasers


Drink-drive police get off charges
Half of all police officers caught drink-driving in the past three years have beaten the charge, raising allegations of one law for police and another for the public. Three officers are still fighting their cases in the courts, including one caught driving while more than three times the legal limit. Even the police's top personnel manager admits it is hard to secure a conviction against an officer. The average conviction rate for all drink-drivers in the past three years was more than 95 per cent, compared with less than 38 per cent for police officers.

95% of us who are charged with drink driving get convicted, amazingly only 38% of Police charged with drink driving get convicted? How come I never see that on Police 10-7? Why can’t we have a cop show on tele where we film cops without them knowing that we are filming them? Wouldn’t that make for actual reality television rather than the pro-cop cheerleader recruitment tool we are currently served up on television screens weekly?

I love how even the Police can’t explain the low conviction rate.

If you drink then drive, you’re a bloody idiot (unless you’re a cop, then Shhhh, we’ll look after you)

My guess would be that a large part would be down to the police knowing when "procedure" hadnt been followed and pointing this out in trial. As procedure is often not followed I am assured this could account for an easy 50% of cases.

What kind of shocks me is police, who see the results of drink driving all the time, still do it.

ahhh, bomber, such a show is a reality! Its called cop busters, check out nevergetbusted.com. it warms my heart. they set up a hidden camera then give dodgy info they have a grow room then the cops run in with a made up warrant to find them growing christmas trees under the lights!

Saying 95% get off is a meaningless comparison since a big chunk of that will be people who did it, and then plead guilty for reduced sentence. But no cop will ever go guilty because they *know* it's the end of their career. You would need to look at the stats for contested EBAs.

And Jeff has it right too. The EBA procedure is so overly complex that it is a lawyers feast. Just today I heard of a guy who blew over 1100 but got off because of a one minute time discrepancy in the notes...

Our EBA law and case law relating to it is so horribly complex, weak and inept that it is very easy for anyone familiar with it to manufacture a defence during the procedure. And if there is alot on the line and you have the motivation or funds to hire a specialist EBA lawyer then your chance of getting off on a ridiculous technicality increases ten fold.

There is an entire industry built up on this fact, all we are seeing are the consequences of poorly written and understood law and people with knowledge of it using that fact to their advantage.
